These terms govern your use of sigilandsage.com and any purchase you make here. By using this site or placing an order, you agree to these terms. The arbitration section below affects how any dispute between us gets resolved, so please read it.

Eligibility

You must be at least 18 years old to purchase from this shop. By ordering, you confirm that you are.

Products, pricing & availability

We do our best to describe products and show colors accurately, but natural materials, hand-poured items, and screen differences mean what you receive may vary slightly. Prices and availability may change at any time, and we may correct errors, cancel an order, or limit quantities at our discretion.

About our goods — please read

Our products are sold as curios and for entertainment, decorative, and personal-practice purposes. We make no claim or guarantee of any specific spiritual, magical, physical, psychological, or financial outcome. Nothing sold here is a substitute for professional medical, legal, financial, or psychological advice. Herbs, oils, and botanicals are not intended to diagnose, treat, cure, or prevent any condition; never ingest a product unless its label explicitly says it is food-safe, and consult a qualified professional before use if you are pregnant, nursing, or managing a health condition. Burn candles and incense responsibly, on a heat-safe surface, and never leave a flame unattended.

Orders & payment

Payment is processed securely by our payment provider; we never see or store your full card details. Placing an order is an offer to buy, which we accept when we ship.

Using this site

You may browse, buy and share our pages. You may not:

• scrape, crawl or bulk-download the shop, its product data or its images by any automated means;
• use our content, photographs or descriptions to train an artificial-intelligence model, or to build any dataset for that purpose, without our written permission;
• resell or republish our product photography or written descriptions;
• attempt to break into any part of the site, probe it for vulnerabilities, or interfere with its operation;
• use the site for anything unlawful.

Intellectual property

The site's text, images, logos, and design are the property of Sigil & Sage and may not be copied or reused without written permission.

Copyright complaints

We respect copyright and act on credible complaints. If you believe something here infringes a copyright you own or represent, email sales@sigilandsage.comwith “Copyright complaint” in the subject line. Include your contact details, identification of the work, the exact URL where the material appears, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and that you are the owner or authorized to act for them, and your signature. We will review it promptly and remove anything that appears to infringe.

No warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the site will always be available or error-free, or that the information on it is complete or current. Any warranty that cannot lawfully be disclaimed is unaffected.

Limitation of liability

To the fullest extent permitted by law, Sigil & Sage is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits or lost data, arising from your use of the site or products — even if we have been told such damages are possible. Our total liability for any claim is limited to the amount you paid for the item at issue. Some states do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability for fraud or for anything that cannot lawfully be limited.

Indemnification

You agree to defend, indemnify and hold harmless Sigil & Sage and its owners and contractors from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of your use of the site, your breach of these terms, or your violation of any law or of anyone else's rights.

Disputes, arbitration and class-action waiver

Please read this carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your case.

Talk to us first. Most problems can be sorted out with an email. Before starting any formal proceeding, please send a written description of the problem and what you want to sales@sigilandsage.com and give us 30 days to resolve it. We will do the same for you.

Binding arbitration. If we cannot resolve it, you and we agree that any dispute, claim or controversy arising out of or relating to this site, these terms, or anything you buy here — whether based in contract, tort, statute, fraud or any other legal theory — will be resolved by final and binding individual arbitration, and not in court. The arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules, conducted in English, and held in Nye County, Nevada or, at your election, by telephone, videoconference or on written submissions only. The award may be entered as a judgment in any court with jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Class-action waiver.YOU AND WE EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this class-action waiver is found unenforceable, then this entire arbitration section does not apply and the dispute proceeds in the courts named below.

Your right to opt out. You may opt out of this arbitration and class-action waiver section by emailing sales@sigilandsage.comwith “Arbitration opt-out” in the subject line within 30 days of first accepting these terms. Include your name and address. Opting out affects nothing else in these terms, and we will not treat you any differently for doing it.

What is not covered. Either of us may bring an individual action in small-claims court if it qualifies, and either of us may go to court for an injunction to stop infringement or misuse of intellectual property. Nothing here prevents you from reporting anything to a government agency.

Governing law

These terms and any dispute arising from them are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. For anything not subject to arbitration — and if the arbitration section is ever held unenforceable — you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Nye County, Nevada.

The rest of the fine print

• Changes. We may update these terms. The version on this page is the one that applies, and the date at the top tells you when it last changed. Continuing to use the shop after a change means you accept it.
• Severability. If any part of these terms is held invalid, that part is limited or removed to the minimum extent necessary and the rest stays in force.
• No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
• Assignment. You may not transfer your rights under these terms. We may transfer ours to a successor if the business is sold.
• Entire agreement. These terms, together with our Privacy Policy, Shipping Policy and Returns Policy, are the whole agreement between us.
